Riad & Riad Successfully Defended a Multinational Food Manufacturing Company in Food Safety Prosecution

Riad & Riad has successfully defended a multinational food manufacturing company in food safety prosecutions involving breach of Food Control Law, the Fraud Combating Law and the National Food Safety laws and regulations. The case started with an initial investigation and dawn raid by NFSA and seizure and testing of goods. The investigations resulted in the authorities bringing a criminal prosecution against the company and the court charging the company’s director with imprisonment and fines.

At the appeal stage, we managed to get full acquittal for the company’s directors and substantive discharge of liability for the company. Our defence strategy relied on scrutinizing the actions of the investigating body to ensure they do not act outside their remit as well as proving due diligence and compliance with food safety regulations. We successfully convinced the court that the company has carried out all reasonable checks on its products and it was reasonable for it to rely on the checks carried out by NFSA at the importation stage.
